This agreement sets out the terms between Thulir Construction and the Client for residential construction services.

This is a standard agreement template used by Thulir Construction. The final signed agreement is executed on appropriate stamp paper as per Tamil Nadu Stamp Act. All blanks are filled during client onboarding.

Payments are to be made within 5 working days of milestone completion. Work continues to the next stage only upon receipt of the stage payment.

Any upgrade in materials beyond this specification requires a written change-order and additional payment to be agreed before execution.

Terms & Conditions
  1. Commencement: Construction commences within 15 working days of Agreement signing payment (10%) and handing over of possession of the site.
  2. Timeline: The estimated duration is indicative. Delays caused by monsoon, client-directed changes, late payment, or government approvals are not counted toward the contractual timeline.
  3. Design Changes: Any changes to the approved drawings after work has begun will be assessed for additional cost and time. No changes are executed without a signed Change Order.
  4. Client Responsibilities: The client shall ensure: (a) clear site access at all times; (b) government plan approvals before commencement; (c) timely payments per the payment schedule; (d) an authorised person for on-site decisions.
  5. Material Procurement: Thulir Construction procures all agreed materials. The client may inspect material delivery. No third-party materials are to be introduced without mutual written consent.
  6. Work Supervision: A qualified site engineer appointed by Thulir Construction supervises all work. The client is entitled to visit the site at any time with prior notice. Daily/weekly progress updates will be shared via WhatsApp/ERP.
  7. Dispute Resolution: Any disputes shall first be resolved by mutual discussion within 30 days. If unresolved, disputes shall be referred to arbitration under the Arbitration & Conciliation Act, 1996. Jurisdiction: Sankari / Salem.
  8. Termination by Client: The client may terminate this agreement by giving 30 days' written notice. The client shall pay for all work completed, materials procured, and a cancellation fee of 5% of the remaining contract value.
  9. Termination by Contractor: Thulir Construction may suspend or terminate work if payment is overdue by more than 15 days beyond the due date, after issuing a written notice.
  10. Force Majeure: Neither party is liable for delays caused by acts of God, government orders, pandemic, or circumstances beyond reasonable control.
  11. Intellectual Property: Architectural drawings and structural designs remain the intellectual property of Thulir Construction unless otherwise agreed in writing.
  12. Safety: Thulir Construction ensures safe construction practices on site. The client and visitors must follow all site safety instructions when on site.
Warranty & Post-Handover Guarantee
Structure — 10 Years
Structural defects in columns, beams, and slab covered for 10 years
Waterproofing — 5 Years
Roof, bathroom, and terrace waterproofing guaranteed for 5 years
Plaster & Finish — 1 Year
Cracks in plaster, tile debonding, and surface defects covered for 1 year
Electrical — 1 Year
Wiring faults and switchboard issues covered for 1 year
Plumbing — 1 Year
Leakages in internal plumbing covered for 1 year from handover
Doors & Windows — 1 Year
Frame settlement, shutter alignment defects covered for 1 year

Warranty excludes: damage due to client modifications, natural disasters, negligence, or normal wear & tear. Warranty claim must be reported in writing within the warranty period.

This agreement is to be executed on stamp paper of appropriate value as per the Tamil Nadu Stamp Act, 1899. One signed copy to be retained by each party.
